What Can I Do If My Ex Is Refusing To Pay The Court Ordered Matrimonial Debt?

Thursday, June 30th, 2011

I have given my Ex, never married we have 1 child together 2 years to comply to the court orders he’s agreed to. #1 being the Matrimonial debt to the home, which he has to pay his half of anything that has his name on it. Property Taxes and home insurance. The mortgage I have been paying for will be settled and his half will have to be reimburse to me when the house sells. He’s emailed me telling me he hopes I go into a financial loss and that I am left homeless.
I am the primary care provider of our child. I have her 98% of the time. He emails me suggesting he hopes death on me soon. He’s just emailed me saying he will not be paying what is now over $5000.00 in property taxes which is his direct obligation to the court order. I recently took the home off the market till he clears up that debt. Otherwise based on this and so much more his intention is to lock my money to the home in court and Lawyers if the home does end up selling. Something I am not willing to risk at this point. I am now going to attempt to pay off the taxes before my home goes into a delinquency status, which last year I was given a notice due to his direct debt. Does this indicate he’s forfeit any entitlement to the little equity he put into the home? I have no time or desire to go back to court over this, I have so many court orders and the laws do nothing it seems that he can get away with anything unless I take him back to court to get him to comply to the court orders. Which is just costly and wastes court time, because he’s angry and vindictive. And even though he uses emails to attack me through my talking to him about my daughter. The Police here say they can do nothing but take him to court.
